Overview

Welcome to Try Haritaki. In these terms, "we", "us", and "our" mean Try Haritaki, operated by HES Holdings LLC, a Wyoming limited liability company.

These Terms apply to every Try Haritaki purchase, including orders placed on tryharitaki.com, shop.tryharitaki.com, and any Try Haritaki branded checkout, landing page, or order form we operate, whatever checkout technology sits behind it. Your card or bank statement will show the descriptor tryharitaki.

By visiting or using our store you agree to these Terms, our Privacy Policy, our Refund Policy, our Subscription Terms, and our Shipping Info. Together they form the whole agreement between us. If you do not agree with them, please do not use the store.

Please read them properly. They cover warranty disclaimers, limitation of liability, subscription billing, refund eligibility, and dispute resolution.

1. Your Account

By agreeing to these Terms you confirm that you are at least the age of majority where you live, and that you consent to any minor dependants using our store on devices you own or manage.

To buy from us you may need to give us your email address and your billing, payment, and shipping details. You confirm that everything you give us is accurate, current, and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for everything that happens on your account. You may not transfer, sell, or assign your account to anyone else.

2. Our Products

We work hard to represent our products accurately, but colours and packaging can look different depending on your screen and device settings. We do not warrant that a product's appearance will exactly match what you saw online.

Product descriptions can change at any time without notice. We may discontinue any product, and we may limit quantities offered to any person, region, or jurisdiction.

Health disclaimer

Statements about Try Haritaki products have not been evaluated by the US Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Speak to your healthcare provider before starting any new supplement, particularly if you are pregnant, nursing, taking medication, or managing a medical condition.

3. Orders and Cancellations

Placing an order is an offer to buy. We may accept or decline any order at our discretion, and your order is not accepted until we confirm it and your payment has cleared.

We ship quickly, usually within hours. Cancellations are governed by our Refund Policy and these terms:

An order can be cancelled within 6 hours of being placed, provided no shipping label has been generated
Once a label exists the order cannot be cancelled. Our 99-Day Money-Back Guarantee applies once it is delivered
Addresses, items, quantities, and discount codes cannot be changed after an order is placed

Returns, refunds, and exchanges happen solely under our Refund Policy. You confirm that your purchases are for your own personal or household use and not for resale or export.

4. Subscriptions

If you start a Try Haritaki subscription you authorise us to charge your payment method every 28 days, at the price shown at the time of each renewal, until you cancel. Your subscription continues until cancelled. There is no minimum term.

The subscription option, billing interval, renewal price, and cancellation method are disclosed at three points before you complete checkout:

On the product page where the subscription option is selected
At checkout, where the line item shows as "Subscribe & Save" with the renewal interval
In your order confirmation email

BY COMPLETING CHECKOUT YOU GIVE YOUR EXPRESS AFFIRMATIVE CONSENT TO THESE RECURRING CHARGES.

You may cancel, pause, skip, or change your subscription at any time online, through the same account you used to sign up. Cancellation is immediate and stops all future charges. Full detail is in our Subscription Terms.

5. Prices and Billing

Prices, discounts, and promotions can change without notice. The price you pay is the price in effect when you place the order, and it is confirmed in your order confirmation email. Unless we say otherwise, posted prices exclude taxes, shipping, handling, customs, and import charges.

You agree to keep your payment and contact details current and accurate so we can complete your transactions and reach you.

You confirm that the payment details you give us are true and complete, that you are authorised to use that payment method, and that you will pay the charges you incur at the posted prices including shipping and applicable taxes.

6. Shipping and Delivery

Delivery times are estimates, not guarantees. We are not liable for delays caused by carriers, customs, or events outside our control. Once we hand a parcel to the carrier, title and risk of loss pass to you.

7. Refunds, Guarantee, and Chargebacks

Refunds, returns, and guarantee claims are governed by our Refund Policy, which includes our 99-Day Money-Back Guarantee.

Before starting any payment dispute or chargeback with your bank, card issuer, or payment processor, you agree to contact us at support@tryharitaki.com and give us a fair chance to put it right.

Filing a chargeback without contacting us first is a breach of these Terms. We reserve the right to contest any chargeback we believe was filed in breach of them, using order records, IP and device data, your acceptance of these Terms at checkout, delivery confirmation, subscription disclosures, and our full correspondence with you.

8. Intellectual Property

Our store and everything in it, including trademarks, text, images, graphics, video, audio, product reviews, and the selection and arrangement of all of it, belongs to Try Haritaki, its affiliates, or its licensors, and is protected by US and international intellectual property law.

These Terms allow you to use the store for your own personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, or transmit any of our material without written consent. Nothing here grants you a licence under any patent, trademark, or copyright of ours, of Shopify, or of any third party. All rights not expressly granted are reserved.

Try Haritaki names, logos, product names, designs, and slogans are our trademarks. Do not use them without our written permission.

9. Third-Party Tools and Links

Our store may give you access to tools operated by third parties that we neither monitor nor control. We provide access to them as is and as available, with no warranties of any kind, and we have no liability arising from your use of them.

Our store may also link to websites operated by others. We are not responsible for reviewing or assessing their content or accuracy, and we are not liable for anything that happens when you visit them.

10. Our Relationship with Shopify

Try Haritaki runs on Shopify, which is how we are able to provide the store to you. Every sale, however, is made directly with Try Haritaki. You agree that Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage, or loss arising from products you buy, and you release Shopify and its affiliates from all claims relating to your transactions with us.

11. Reviews and Feedback

If you send us ideas, suggestions, reviews, proposals, or any other content, you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display it in any medium, including commercially.

You confirm that you own or have the rights to everything you send us, that you have disclosed any compensation or incentive you received in connection with it, and that it complies with these Terms.

We are not obliged to keep your feedback confidential, pay for it, or respond to it. We may edit or remove it at our discretion.

12. Errors and Inaccuracies

Occasionally our store may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct these, and to change information or cancel orders where information was inaccurate, at any time and without prior notice, including after you have submitted an order.

13. Things You May Not Do

You may use our store for lawful purposes only. You may not use it, directly or indirectly, for any unlawful or malicious purpose, to break any law or regulation, to infringe anyone's intellectual property, to harass, abuse, defame, or harm our staff or anyone else, to transmit false or misleading information, to send spam or unsolicited promotional material, or to impersonate anyone.

You also agree not to upload viruses or malicious code, resell or exploit any part of the store, collect other people's personal information, spider, crawl, or scrape the site, or interfere with its security features.

We may suspend, disable, or close your account and refuse future orders at any time, without notice, if we determine you have breached these Terms. That includes abuse of our refund or guarantee policies, fraud, and repeat misuse of our promotions.

14. Termination

We may end this agreement or your access to the store at our discretion at any time without notice, and you remain liable for any amounts owed up to and including the date of termination.

The following survive termination: Intellectual Property, Refunds Guarantee and Chargebacks, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnity, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Disputes, Privacy, and anything else that by its nature should survive.

15. Disclaimer of Warranties

Information on our store is general information only. We do not warrant that it is accurate, complete, or useful, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY TRY HARITAKI, THE STORE AND ALL PRODUCTS OFFERED THROUGH IT ARE PROVIDED AS IS AND AS AVAILABLE, WITHOUT REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE STORE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRY HARITAKI, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND THOSE OF SHOPIFY, SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE STORE OR ANY PRODUCTS BOUGHT THROUGH IT, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATING TO THE STORE OR PRODUCTS BOUGHT THROUGH IT WILL NOT EXCEED THE AMOUNT YOU PAID TO TRY HARITAKI IN THE 90 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

17. Indemnity

You agree to indemnify, defend, and hold harmless Try Haritaki, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, payable to a third party arising out of your breach of these Terms or the documents they incorporate, your breach of any law or third-party right, or your use of the store.

We will notify you of any claim we seek indemnity for. Failure to notify promptly does not release you unless you are materially prejudiced. We may control the defence and settlement at your expense, including choice of counsel, but will not settle any claim that imposes non-monetary obligations on you without your consent, which you will not unreasonably withhold.

18. Severability, Waiver, and Assignment

If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted and the unenforceable part severed. The rest of the Terms remain valid and enforceable.

Our failure to enforce any right or provision is not a waiver of it.

These Terms, together with our Refund Policy, Subscription Terms, Shipping Info, and Privacy Policy, are the entire agreement between us and supersede anything said or written beforehand. Ambiguities will not be construed against the drafter.

You may not assign or transfer these Terms or your rights under them without our written consent, and any attempt to do so is void. We may assign or transfer ours without notice.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of laws principles. You and Try Haritaki consent to venue and personal jurisdiction in the federal and state courts of Natrona County, Wyoming for any action not subject to the process below.

Talk to us first

Before filing any claim against us, email support@tryharitaki.com with a written description of your claim and give us 60 days to resolve it informally. This does not apply to claims for injunctive relief relating to intellectual property.

Binding arbitration

If informal resolution has not settled the dispute within 60 days, you and Try Haritaki agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchases, or the store will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Natrona County, Wyoming, or by videoconference or on the documents at your election. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver

You and Try Haritaki each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim alone proceeds in court and the rest of this section continues to apply.

Exceptions

Either of us may bring an individual action in small claims court, and either of us may seek injunctive relief in court for infringement or misuse of intellectual property.

How to opt out

You can opt out of arbitration and the class action waiver by emailing support@tryharitaki.com within 30 days of your first purchase, with the subject line "Arbitration Opt-Out" and your full name and order number. Opting out does not affect any other part of these Terms.

20. Changes to These Terms

The current version of these Terms is always on this page. We may update, change, or replace any part of them by posting the update here, and it is your responsibility to check periodically. Continuing to use the store after a change is posted means you accept it.
